Please read these Terms and Conditions carefully before using the Key Stage 3–5 Research Site, henceforth referred to as the “Research Site”.

By accessing or using the Research Site, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform.

Definitions - “Kita”, “we”, “us”, “our”: Kita Education Ltd, company number 13264075 - “Research Site” or “Service”: The Kita temporary research website, provided solely for authorized users to view participant information for a specific research project. - “User”: Any individual accessing or using the Research Site, typically students and educators who are prospective participants or active participants in the Key Stage 3–5 Research study.

4. Access to the Key Stage 3–5 Research site
4.1 Service Availability The Research Site is provided free of charge for a limited research period. We do not guarantee uninterrupted access.

• Violate any applicable laws or regulations
• Share access credentials with unauthorised users

5.3 Consequences of Violations Violations of these Terms may result in:

• Warning from the Kita team
• Temporary or permanent suspension of account
• Removal of content
• Notification to school authorities
• Legal action if appropriate

6. Intellectual Property 6.1 Kita Intellectual Property Kita owns all intellectual property rights in:

• The Kita platform and its features
• Platform design, graphics, and user interface
• Kita branding and logos
• Documentation and materials created by Kita These rights are protected by copyright, trademark, and other intellectual property laws.

8. Privacy and Data Protection Our Privacy Policy explains how we handle personal data. Key points:

• We collect personal data solely for the purposes of the research study as detailed in our Privacy Policy
• Student data is never sold or used for marketing By using Kita, you consent to data processing as described in the Privacy Policy.

9. Limitation of Liability 9.1 Service Provision Kita is provided “as is” without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Compatibility with all devices or browsers
• Freedom from bugs or technical issues

9.2 Exclusions and Limitations Nothing in these Terms excludes liability for:

• Death or personal injury from negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under English law

Subject to the above, we are not liable for:

• Indirect or consequential losses

• Actions of other users

• Complying with school policies
• Their own conduct on the platform

10. Changes to Terms We may update these Terms from time to time. Changes will be posted on our website, and schools will be notified of significant changes.

Continued use of the Research Site after changes constitutes acceptance of the updated Terms.

11. Termination The Research Site is a temporary environment provided for the duration of the research study.

We may suspend or terminate access if:

• These Terms are violated
• Account activity appears suspicious or fraudulent
• We discontinue the service Upon termination, access to user work will be provided as agreed with the school.

Following termination, student data will be deleted or returned to the school in accordance with the Privacy Policy and the school’s instructions.

12. Third-Party Links and Services The Research Site may contain links to third-party websites (e.g., Google Forms). We are not responsible for the content or practices of third parties.

13. Governing Law and Jurisdiction These Terms are governed by English law.
For consumers: Courts of England and Wales have non-exclusive jurisdiction. Residents of Northern Ireland may bring proceedings in Northern Ireland; residents of Scotland may bring proceedings in Scotland.
For businesses: Courts of England and Wales have exclusive jurisdiction.
